1. Acceptance of Terms
By making a booking through the DRIVE WITH US website at https://drivewithus.com.au (the "Website") or by attending a driving lesson with DRIVE WITH US, you agree to be bound by these Booking Terms and Conditions ("Terms"). If you do not agree with these Terms, do not make a booking.
These Terms govern all bookings, lessons, cancellations, and related services. Use of the Website is governed by our separate Website Terms and Conditions available at https://drivewithus.com.au/terms-and-conditions/. Your personal information is handled in accordance with our Privacy Policy available at https://drivewithus.com.au/privacy-policy/.
2. Eligibility
To book and attend a driving lesson with DRIVE WITH US, you must:
- Hold a valid South Australian learner's permit or provisional licence (or equivalent interstate or international licence recognised in South Australia)
- Carry your licence or permit with you at every lesson — lessons cannot proceed without it
- Be at least 16 years of age (or the minimum age required to hold the relevant licence or permit)
- Be fit to drive and not under the influence of alcohol, drugs, or any substance that may impair your ability to operate a vehicle
If you are under 18 years of age, your parent or legal guardian must consent to these Terms on your behalf.
3. Bookings
3.1 How to Book
Bookings are made through the Website. All bookings are subject to instructor availability and are confirmed via email and/or SMS notification.
3.2 Lesson Duration
Lessons are scheduled for the duration selected at the time of booking. Lesson time includes a brief pre-lesson check and post-lesson debrief.
3.3 Late Arrivals
If you arrive late to a lesson, the lesson will still end at the originally scheduled time. Lost time due to late arrival will not be made up or refunded. If you are more than 15 minutes late without notice, the lesson may be treated as a no-show and the full fee forfeited.
3.4 Lesson Location
You are responsible for being at the agreed pick-up location at the scheduled lesson time. If you need to change the pick-up location, you must notify us as soon as practicable before the lesson.
4. Payments
4.1 Payment at Time of Booking
Full payment is required at the time of booking unless otherwise arranged. Payments are processed securely through Stripe and PayPal via WooCommerce. DRIVE WITH US does not store your credit card or payment details.
4.2 Pricing
Lesson prices are as displayed on the Website at the time of booking. We reserve the right to update pricing at any time, but any price changes will not affect bookings already confirmed and paid for.
5. Cancellations and Refunds
5.1 Cancellation by You
You may cancel or reschedule a booking free of charge provided you give at least 24 hours' notice before the scheduled lesson time. Cancellations and rescheduling can be made through the Website or by contacting us directly.
If you cancel with less than 24 hours' notice, the full lesson fee will be forfeited and no refund will be provided.
5.2 No-Shows
If you fail to attend a scheduled lesson without prior notice, the full lesson fee will be forfeited.
5.3 Cancellation by Us
We reserve the right to cancel or reschedule a lesson due to instructor illness, vehicle issues, severe weather conditions, or other circumstances beyond our reasonable control. If we cancel a lesson, you will be offered the choice of rescheduling at no additional cost or receiving a full refund.
5.4 Refund Method
Refunds, where applicable, will be processed to the original payment method and may take up to 10 business days to appear in your account.
6. Gift Vouchers
6.1 Purchase and Redemption
Gift vouchers can be purchased through the Website and are redeemable for driving lessons with DRIVE WITH US. Vouchers are applied at the time of booking.
6.2 Validity
Gift vouchers are valid for 36 months from the date of purchase, in accordance with the Australian Consumer Law. Vouchers cannot be redeemed for cash and are non-transferable unless otherwise stated at the time of purchase.
6.3 Lost or Stolen Vouchers
DRIVE WITH US is not responsible for lost or stolen gift vouchers. We may, at our discretion, reissue a voucher if proof of purchase is provided.
7. Medical Conditions and Fitness to Drive
7.1 Disclosure Obligation
You are required to inform your instructor before the commencement of any lesson of any medical condition, disability, or medication that may affect your ability to safely operate a vehicle, including but not limited to:
- Epilepsy or seizure disorders
- Diabetes requiring insulin or medication
- Vision or hearing impairments
- Heart conditions
- Sleep disorders
- Mental health conditions that may affect concentration or reaction time
- Any condition for which your licence or permit is subject to restrictions or conditions
This disclosure must be made at your first lesson and updated promptly if your circumstances change.
7.2 Instructor's Right to Refuse or End a Lesson
The instructor reserves the right to refuse to commence or to terminate a lesson at any time if, in the instructor's reasonable opinion, you are unfit to drive due to illness, impairment, fatigue, the influence of alcohol or drugs, or any other condition that may compromise safety. In such cases, the full lesson fee will apply and no refund will be provided.
7.3 Licence Conditions
If your licence or permit is subject to any conditions (e.g., requirement to wear corrective lenses, vehicle modifications, restricted hours), you must comply with those conditions at all times during lessons. Failure to disclose licence conditions may result in the lesson being terminated without refund.
8. Video and Audio Recording
8.1 Recording During Lessons
DRIVE WITH US vehicles may be equipped with in-car video and audio recording devices. Recordings may be made during driving lessons for the following purposes:
- Safety — to provide an objective record of events in the case of an incident, near-miss, or dispute
- Driver training and compliance — to support instructor assessment, provide feedback on driving performance, and maintain training standards
- Insurance and legal purposes — to support insurance claims or legal proceedings in the event of an accident or incident
8.2 Consent
By booking and attending a lesson with DRIVE WITH US, you acknowledge and consent to video and audio recording during your lesson. If you do not consent to being recorded, you must notify us before the lesson. We will discuss alternative arrangements where possible; however, we reserve the right to decline to proceed with the lesson if recording cannot be accommodated.
8.3 Storage and Access
Recordings are stored securely and retained only for as long as necessary to fulfil the purposes described above. Recordings are not shared with any third party unless required for insurance claims, legal proceedings, or as required by law. Your rights in relation to recorded data are outlined in our Privacy Policy at https://drivewithus.com.au/privacy-policy/.
9. During Your Lesson
9.1 Road Rules
You must obey all South Australian road rules and traffic laws at all times during your lesson. Your instructor will provide guidance and direction, but you remain responsible for the safe operation of the vehicle under the instructor's supervision.
9.2 Instructor Directions
You must follow the reasonable directions of your instructor at all times. The instructor has dual controls and may intervene at any time to ensure the safety of all vehicle occupants and other road users.
9.3 Behaviour
You are expected to behave respectfully and appropriately towards your instructor at all times. DRIVE WITH US reserves the right to terminate a lesson immediately and refuse future bookings if you engage in abusive, threatening, or inappropriate behaviour. No refund will be provided in such circumstances.
9.4 Seatbelts and Safety
You and all vehicle occupants must wear seatbelts at all times during the lesson.
10. Vehicle, Insurance, and Accidents
10.1 Our Vehicle
DRIVE WITH US provides a fully insured, dual-controlled vehicle for all lessons. The vehicle is maintained and roadworthy in accordance with South Australian requirements.
10.2 Insurance
Our vehicle is covered by comprehensive motor vehicle insurance. In the event of an accident during a lesson, our insurance policy will generally cover damage to the DRIVE WITH US vehicle and third-party property, subject to the terms of our insurance policy.
10.3 Insurance Excess
If an accident occurs during a lesson and is determined to have been caused or contributed to by the student's actions (including failure to follow instructor directions), the student may be liable for the insurance excess amount. The current excess amount will be advised at the time of booking or upon request.
10.4 What to Do in the Event of an Accident
If an accident or incident occurs during a lesson, you must:
- Follow the instructions of your instructor
- Remain at the scene as required by law
- Cooperate with the exchange of details with any other parties involved
- Provide a truthful account of the incident
- Cooperate with any subsequent insurance claim or investigation
10.5 Exclusions
Our insurance may not cover damage or liability arising from:
- Driving under the influence of alcohol or drugs
- Deliberately reckless or illegal driving behaviour
- Failure to follow instructor directions that directly led to the incident
In such cases, you may be held personally liable for all costs, damages, and losses.
10.6 Personal Belongings
DRIVE WITH US is not responsible for loss or damage to your personal belongings during a lesson.
11. Limitation of Liability
To the maximum extent permitted by law, DRIVE WITH US, its directors, employees, instructors, and agents shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of income, time, or opportunity arising from cancelled or rescheduled lessons
- Failure to pass a driving test or obtain a licence
- Injury or loss arising from your failure to disclose a medical condition or comply with road rules
DRIVE WITH US does not guarantee that you will pass your driving test or obtain your licence as a result of taking lessons with us.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
12. Termination
We reserve the right to refuse service or cancel future bookings at our discretion, including where:
- You have breached these Terms
- You have repeatedly failed to attend lessons without notice
- Your behaviour poses a safety risk to the instructor, yourself, or other road users
- You have failed to disclose a relevant medical condition
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Website with an updated "Last Updated" date. Changes will not affect bookings already confirmed and paid for at the time of the change.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of South Australia, Australia, and the applicable laws of the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and any courts that may hear appeals from those courts.
